Malema Sentence Puts EFF’s Future Under Pressure

SOUTH AFRICA: Julius Malema, the founder and leader of South Africa’s Economic Freedom Fighters (EFF), has been sentenced to five years in prison for firing an assault rifle at a 2018 rally — a ruling that places the party’s future under intense pressure.

The sentence, handed down by Magistrate Twanet Olivier in the KuGompo City Regional Court (formerly East London), came after Malema was convicted on charges of unlawful possession of a firearm and discharging a weapon in public.

However, the court granted Malema leave to appeal both the conviction and sentence. He will not be taken into custody immediately and can continue his political activities while the appeals process unfolds — a process analysts say could take years.

But the uncertainty alone has exposed a vulnerability in the EFF.

Independent political analyst Ralph Mathekga said the sentence, even if suspended by appeals, creates fresh uncertainty for the EFF.

“The party has built itself almost entirely around Malema’s personality. Succession planning has been minimal, so this development tests the organisation’s depth,” Mathekga said.

The EFF currently holds about 10 percent of seats in the National Assembly and remains a vocal player in opposition politics, often pushing for radical economic policies such as mine nationalisation and land expropriation without compensation.

Under South African law, a sentence of more than 12 months’ imprisonment without the option of a fine can disqualify a person from serving as a Member of Parliament. If the sentence is ultimately upheld after all appeals, Malema could lose his seat and be barred from parliament for five years.

Hundreds of EFF supporters gathered outside the court, chanting and expressing solidarity with their leader. The EFF described the ruling as a continuation of a “politically motivated witch hunt” aimed at weakening the opposition party.

Malema’s legal team argued that the weapon was not a real assault rifle as alleged and that the prosecution was selective. Prosecutors had pushed for a maximum 15-year term, describing Malema’s actions as reckless and setting a poor example for a public figure and lawmaker.

Supporters view Malema as a champion for young Black South Africans frustrated by high unemployment and slow progress on economic transformation more than 30 years after apartheid.

Critics, however, accuse him of inflammatory rhetoric and question the consistency between his anti-elite messaging and reports of his personal wealth.

The case dates back to video footage from the EFF’s fifth anniversary celebrations in Mdantsane, Eastern Cape, in 2018, where Malema was seen firing shots into the air in front of a large crowd. He has consistently maintained his innocence, arguing the incident was exaggerated for political reasons.

The EFF has vowed to fight the sentence vigorously through the courts and to mobilise its base. Political observers will be watching whether the party can maintain its momentum if Malema’s legal battles drag on, or whether it can begin building structures less dependent on one leader.

The appeals process is expected to determine Malema’s long-term eligibility to serve in parliament and the EFF’s role in future coalitions or elections.

For now, the party’s future hangs in the balance — tied to the fate of one man.
